City of Rochester Issues Advisories to Local Businesses Selling CBD Infused Food and Drinks in Violation of State Regulations

ROCHESTER — City Manager Blaine Cox reports that Rochester officials recently issued advisories to local businesses that they were in violation of state and federal regulations, which prohibit the sale of cannabidiol (CBD) infused foods and drinks.

CBD-infused foods and drinks are banned under federal law, and are unlawful under New Hampshire’s Food Protection program.

The City of Rochester was recently notified of these regulations and asked to enforce them among local businesses in violation by the Food Protection Section of the New Hampshire Department of Health and Human Services’ Bureau of Public Health Protection.

“It is against state and federal regulations to sell these items, and as a city we are required to notify and stop businesses who are doing so,” said Jim Grant, director of Rochester’s building, zoning and licensing services. “Once it came to our attention that these businesses were violating these state regulations, we took corrective action that we believe was appropriate and fair to our businesses.”

Businesses that continue to violate state and federal regulations run the risk of having their food licenses revoked by the Rochester Board of Health.
